TERMS AND CONDITIONS FOR SERVICE SUPPLY TO REGISTERED USERS OF THE ROTATION WEB SITE

General Statement
 
Farm-Market Media Ltd agrees to provide its subscribing clients access to its Rotation programs and databases supplied by our server on the following basis:

• We will provide you with a unique identification and password code to enable individual subscribers to access our service.
• We undertake to maintain and keep confidential the database containing your farm rotation data for your use while you are a subscriber.
• We will make genuine and commercially reasonable efforts to make the services you have subscribed for available to you 24 hours a day and, if the system malfunctions, to restore those services as soon as reasonably possible.
• But if in spite of those efforts, we cannot provide or restore the service (even if the failure is our fault) we are not liable to you. We explain what this means in the section entitled "Limits on our Liability".
The reasons for these limits on our service levels are because:
• We do not own or control all the facilities and communication lines necessary for access, and therefore, we cannot guarantee that the service will be uninterrupted or error free.

Trading Terms for Rotation Service Users

Service Fee

 Annual Fee    $200.00 (plus GST for NZ subscribers)
 Monthly Fee   $ 27.00 (plus GST for NZ subscribers)

The service fee may be varied from time to time. Such variations will be notified here.

Terms of Trade 

1. Exclusive Service - Access is limited to one economic farming unit per subscribed fee.
2. Site Access - Password access is granted on receipt of subscription or renewal of subscription.
3. Suspension of Service - The service is suspended to any client while payments are in arrears.
4. Account reactivation - Accounts can be re-activated at any time by making payment via logon. 
5. Farm Data - Farm data entered into suspended accounts remains available on re-activation.
6. Renewal - Renewal of access to the service will be at the notified current fee at the time of renewal.

Payment Terms

All Payments are in New Zealand dollars.
GST is added for NZ subscribers
All subscribers will be e-mailed a Tax Invoice.
The Visa Credit Card is the only card presently able to be processed.

Annual Fee - Visa Credit Card.

1. The annual subscription for Rotation is on a pre-paid basis.
2. A 7-day free trial period is provided from when you submit your initial registration.
3. At the expiry of your free trial, on your next logon, you will be requested to make your Visa payment via a payment window for your continued access to Rotation. 
4. On each subsequent anniversary of your subscription you will be requested to make a further payment for your continued access to the service.

Monthly Fee - Visa Credit Card.

1. The monthly subscription for Rotation is on a pre-paid basis.
2. A 7-day free trial period is provided from when you submit your initial registration.
3. At the expiry of your free trial, on your next logon, you will be requested to make your Visa payment via a payment window for your continued access to Rotation. 
4. On each subsequent monthly anniversary of your subscription you will be requested to make a further payment for your continued access to the service.

Alternate Payment Methods- Cheque or Direct Deposit

Provision is made for alternate methods of payment.

Service granted under these methods of payment will be activated on registration.

If a clients payment has not been received by Rotation within ten days of registration Logon and access rights will be terminated.

Telegraphic Transfer, Direct Credit or Internet Bank Transfer Payments

Refunds

No refunds will be made for services pre purchased from Rotation

 Service Agreement

Rotation users agree to the following:
1. You will maintain the security of your password.
2. You agree to change your password when requested to do so by us.
3. You agree you will not allow access to or on sell this service with out prior agreement in writing from the provider of the service.
4. You agree not to use the service to breach anyone else’s rights.
5. You agree that you will not cause or help to cause the security or integrity of this or any other linked computer system to be compromised whether by way of hacking, introducing harmful code or in any other way. 

Confidentiality

All parties to this agreement understand that Farm- Market Media Ltd has taken all reasonable steps to maintain security and confidentiality of the site. In addition Farm-Market Media Ltd will take all reasonable commercial efforts to protect the confidentiality of your information data generated while using the Farm-Market Media Ltd site.

Use of Subscribers Information

When you complete your application for our services you authorise our agents to collect information about you and hold it at our office.

Under the provisions of the Privacy Act 1993 you may request access to and correction of your personal information. Requests must be in writing, which includes e-mail. We may charge a fee for the reasonable costs incurred in responding to these requests but we will disclose the costs to you before those costs are incurred.

Our Authority for Service

We can terminate the services that you have subscribed for without notice or liability to you if you breach any of these terms and conditions.

Communications and Notices

These terms and conditions may be changed from time to time as the site develops. These changes may include alterations to our pricing structure for future subscriptions.

We will inform you by e-mail or posting a message in the appropriate location on the site home page of any changes as they occur. Once we have posted the e-mail or other message you are deemed to have received it

Limits on our Liability

1. By using our services you do so at your sole risk.
2. We do not warrant that our service will be uninterrupted or error-free.
3. We do not make any warranties or undertakings as to the reliability of the results to be obtained from the service, data, information or the experiences arising from your use of the site and your application of the knowledge as that is a matter of your own assessment given its unique nature based on your original inputs.
4. We distribute our service on an "as is" basis without warranties of any kind, either express or implied.
5. In particular, we are not liable to you - whether in contract or tort or under any other legal principle - for any direct or indirect losses or damages of any kind. These damages include but are not limited to loss of business, profits, work stoppage, computer or software failure or malfunction or any other damage
